5. Important Notes in Importation, Manufacturing, and Business Policies under the Legal Regulations for Flycam/UAV/Drone in Vietnam

| Important Notes | – The results of measurements/testing from domestic or foreign laboratories that have not been designated, recognized, or acknowledged, or the test results from the manufacturer, shall not be used for conformity assessment against this technical regulation.
– Regarding QCVN 54:2020/BTTTT and QCVN 65:2021/BTTTT: The application of technical requirements under extreme/critical conditions is suspended until the end of June 30, 2025, for products and goods that are not dedicated WiFi transceivers (WiFi Modem, WiFi Access Point), HS code 8517.62.51, but which integrate WiFi transceiver functionality. – The Ministry of Information and Communications (now the Ministry of Science and Technology) updates the list of Group 2 goods periodically (including the product list and corresponding technical regulations). Importing and manufacturing enterprises dealing with WiFi transceiver devices must regularly monitor and update information to ensure products consistently meet the current technical regulations and management requirements. – For QCVN 112:2017/BTTTT, products and goods do not require conformity certification but only need to execute a Declaration of Conformity. – The formula [5 160 +(g x 20) MHz] (1) in Clause 2.1.2 (Technical requirements on limits) of QCVN 65:2021/BTTTT shall not be applied. – Products and goods with radio frequency emission functions must comply with Vietnam’s planning and allocation of radio frequencies, the corresponding technical and operational conditions, as well as current legal regulations on radio frequency. – Organizations and enterprises manufacturing, importing, distributing, and using the products must commit to strictly comply with the law on the management and use of radio frequencies. – Unmanned aerial vehicles (Drones) fall under the management authority of the Ministry of National Defence (MND); therefore, enterprises must obtain a written approval from this authority when importing. – Enterprises must fulfill their tax obligations to the state when importing. Enterprises should request a Certificate of Origin (C/O) from the exporter to benefit from special preferential import tax rates. – Enterprises must correctly determine the HS code to complete the necessary procedures accurately, avoiding time loss and penalties. – Effective from January 1, 2026, cameras capable of recording and transmitting data via radio waves, such as Flycams, Drones with cameras, and IP Cameras, will be subject to quality inspection and conformity certification according to QCVN 135:2024/BTTTT. |
