I. WHAT IS A LITHIUM BATTERY?
A Lithium Battery is a type of battery that utilizes lithium compounds as its electrode material and is rechargeable (also known as a secondary battery). This battery type typically has a superior energy density compared to many other battery types, hence its widespread use in electronic devices like mobile phones, notebook computers, etc. The Lithium Battery is classified into several types, including the Lithium-Ion Battery, Lithium Polymer Battery, detached Lithium Battery, and integrated Lithium Battery.
II. LEGAL REGULATIONS FOR THE MANUFACTURING AND IMPORT OF LITHIUM BATTERY

– Circular No. 10/2020/TT-BTTTT, issued on May 7, 2020, by the Ministry of Information and Communications, stipulating the methods and procedures for regulation conformity certification and declaration of regulation conformity; – Circular No. 15/2018/TT-BTTTT, issued on November 15, 2018, by the Ministry of Information and Communications, specifying regulation conformity certification and declaration of regulation conformity for specialized information technology and communication products and goods (such as the Lithium Battery); – Decree 74/2018/ND-CP, issued on May 15, 2018, by the Government, stipulating the state inspection procedures for imported goods (which applies to a Lithium Battery). |

– Currently, the Ministry of Information and Communications (MIC) only mandates the declaration of regulation conformity for the safety characteristic requirements specified in Article 2.6 of QCVN 101:2020/BTTTT, and it is not yet mandatory for performance requirements; – In the event an enterprise imports a Lithium Battery in small quantities, insufficient for testing per QCVN 101:2020/BTTTT, the enterprise may request the Vietnam Telecommunications Authority to approve the declaration of regulation conformity based on foreign test results; – To Test a Lithium Battery per QCVN 101:2020/BTTTT, the enterprise needs a minimum required sample quantity to provide to the Testing laboratory

| 7 | Detailed implementation procedures before circulating the product to the market | – Imported Lithium Battery
(1) Complete the State control registration (on quality of products) at the Vietnam Telecommunications Authority; (2) Transmit the import customs declaration together with the registration for quality inspection; (3) Secure Customs Clearance for the goods, and transport the goods to the enterprise’s storage warehouse; (4) Conduct measurement and product testing according to the applicable Technical Regulation; (5) Submit the certificate of conformity and self-assessment of conformity to the state management agency for the Declaration of Regulation Conformity; (6) Affix the ICT/CR conformity mark to the Lithium Battery product before placing it on the market. – Domestically manufactured Lithium Battery (1) Conduct product testing according to the applicable Technical Regulation; (2) Complete the Declaration of Regulation Conformity for the product at the Vietnam Telecommunications Authority; (3) Affix the ICT/CR conformity mark to the Lithium Battery product before placing it on the market. |
