I. WHAT IS A VACUUM CLEANER?
A vacuum cleaner is an electrical device that helps clean dirt, small debris, and microscopic particles on floors, carpets, curtains, and many other surfaces using a vacuum mechanism. When in operation, an electric motor creates a low-pressure airflow, sucking dust into a conduit and retaining it in a filter bag or dust compartment. Some high-capacity models are designed with a water or liquid suction function, making cleaning easier and more effective.
In today’s market, vacuum cleaners come in many different designs and functions, such as handheld vacuum cleaners, upright vacuum cleaners, cordless vacuum cleaners, or automatic robot vacuums. Each type is equipped with specific features like power adjustment, fine dust filtration, surface recognition sensors, or automatic return to the charging station.

2. Legal Regulatory Documents
To ensure that vacuum cleaner equipment is legally circulated in the Vietnamese market and safe for consumers, manufacturing and importing organizations and individuals must fully comply with Legal Regulations for Vacuum Cleaners in Vietnam according to the system of standards, technical regulations, and current management documents. Specifically, the relevant legal documents and technical standards include:

– Circular No. 01/2022/TT-BKHCN dated February 16, 2022, of the Ministry of Science and Technology amending Circular No. 07/2018/TT-BKHCN and Circular No. 08/2019/TT-BKHCN.
– Circular No. 06/2020/TT-BKHCN dated December 10, 2020, of the Ministry of Science and Technology providing instructions and measures for the implementation of Decrees 132/2008/NĐ-CP, 74/2018/NĐ-CP, 154/2018/NĐ-CP, and 119/2017/NĐ-CP.
– Circular No. 07/2018/TT-BKHCN dated June 06, 2018, of the Ministry of Science and Technology regarding Amendment 1:2018 QCVN 9:2012/BKHCN – National technical regulation on electromagnetic compatibility for household and similar electrical and electronic equipment.

These documents specify technical requirements, testing methods, labeling, conformity certification, and declaration of conformity for products. These are the Legal Regulations for Vacuum Cleaners in Vietnam, ensuring products fully meet safety and quality requirements according to current regulations.
3. Types of Vacuum Cleaners within the Scope of Application
Based on Decision No. 2711/QĐ-BKHCN, vacuum cleaners with self-contained motors (including commercial vacuum cleaners) must be tested, certified, and declared for conformity according to QCVN 9:2012/BKHCN and Amendment 1:2018 QCVN 9:2012/BKHCN before market circulation. Specifically, this includes the following product groups:

Vacuum cleaners with self-contained electric motor, power of 1,500 W and having a dust bag or receptacle capacity of 20 liters (HS Code: 8508.11.00);

Vacuum cleaners with self-contained electric motor, other types suitable for domestic use (HS Code: 8508.19.10);
-
Other vacuum cleaners with self-contained electric motor (HS Code: 8508.19.90).
According to TCVN 7492-1:2018 (CISPR 14-1:2016), vacuum cleaners are classified as household electrical appliances with integrated motors, powered by AC or DC, and fall within the scope of the standard for radio frequency interference emissions in the range of 9 kHz to 400 GHz. These products must undergo Electromagnetic Compatibility (EMC) testing to evaluate emission levels and ensure they do not interfere with the operation of other electrical-electronic devices in the same environment.

Consequently, most household vacuum cleaners must be tested, certified, and declared for conformity according to QCVN 9:2012/BKHCN (effective since June 1, 2014) and Amendment 1:2018. This ensures that products fully meet the Legal Regulations for Vacuum Cleaners in Vietnam, specifically regarding electromagnetic compatibility, before being legally permitted for circulation in the Vietnamese market.
4. Applied Standards/Technical Regulations
According to Decision No. 2711/QĐ-BKHCN, vacuum cleaners are Group 2 products and goods—a group with the potential to cause unsafety—under the management responsibility of the Ministry of Science and Technology (MOST). They must undergo testing, certification, and declaration of conformity regarding electrical safety and electromagnetic compatibility according to QCVN 9:2012/BKHCN and Amendment 1:2018 QCVN 9:2012/BKHCN.
QCVN 9:2012/BKHCN stipulates that vacuum cleaners must meet technical requirements according to TCVN 7492-1:2018 (CISPR 14-1:2016) – the standard for Electromagnetic Compatibility – Requirements for household appliances, electric tools, and similar apparatus (Part 1: Emission). Accordingly, vacuum cleaners must ensure requirements for Terminal disturbance voltage limits and Disturbance power limits (30-300 MHz) as specified in this standard.
5. Important Notes on Import, Production, and Business Policies
– Testing and certification must be performed by a testing-certification organization that is designated, registered, or accredited by the Ministry of Science and Technology (MOST).
– Vacuum cleaners manufactured domestically, imported, or traded must be certified for EMC conformity according to Method 1 (typical sample testing).
– Equipment must have product labels as regulated, undergo conformity certification, bear the conformity mark (CR Mark), and be subject to inspection by quality control agencies.
– The conformity certificate is valid for no more than 3 years. Enterprises must archive records for at least 10 years from the date the last product of the registered type is released.
– QCVN 9:2012/BKHCN does not apply to vacuum cleaners powered by batteries, rechargeable batteries, or other DC power sources.
– TCVN 7492-1:2018 (CISPR 14-1:2016) stipulates that for vacuum cleaners with self-contained motors without a vacuum block, the device must be operated with empty bags once per minute or according to the manufacturer’s instructions. For cleaning robots using batteries/accumulators for cleaning functions, both the robot and the cleaning block must undergo testing.
– Used vacuum cleaners are prohibited from importation.
– Import tax is a mandatory obligation when performing import procedures for vacuum cleaners. Enterprises should obtain a Certificate of Origin (C/O) from the exporter to enjoy special preferential import tax rates.

Understanding and complying with the Legal Regulations for Vacuum Cleaners in Vietnam is not only a mandatory requirement for products to be permitted for circulation in the Vietnamese market but also a key factor helping enterprises protect their reputation, minimize legal risks, and enhance competitiveness.
