QCVN 04:2009/MOST (Circular No. 21:2016/MOST) – National technical regulation on Safety for Electrical and Electronic appliances

I. SCOPE

QCVN 04:2009/MOST applies to organizations and individuals (hereinafter referred to as Enterprises) engaged in the manufacturing, importing, distributing, and retailing of electrical and electronic equipment, including instant electric water heaters, electric water heaters and storage water heaters, hair dryers and other hair care devices, electric kettles, rice cookers, electric fans, electric irons, microwave ovens, electric ovens, portable electric grills, PVC-insulated wires with a rated voltage up to and including 450/750 V, immersion-type electric water heaters, tea or coffee makers, and hand dryers. It also applies to relevant state management agencies and other related organizations and individuals.

II. MAIN CONTENTS

Electrical and electronic equipment refers to devices directly connected or connected via sockets to low-voltage power sources, used in households, commercial settings, and other locations with similar purposes (excluding medical devices and telecommunication equipment).

Low-voltage power refers to an electrical source with alternating current (AC) voltage ranging from 50 V to 1000 V and direct current (DC) voltage ranging from 75 V to 1500 V.

1. Safety requirements

Electrical and electronic equipment specified in QCVN 04:2009/MOST must ensure safety in compliance with the corresponding national standards (TCVN) as follows:

2. Management Requirements

a) Market circulation conditions

Electrical and electronic devices circulating on the market must have labels according to the regulations of the law on product labeling; they must be certified for conformity, bearing the conformity mark (CR) as required by this Technical Regulation, and are subject to market inspection by the product and goods quality inspection authorities (hereinafter referred to as the inspection authorities).

The National Technical Regulation QCVN 04:2009/MOST/Amendment 01:2016 on Safety for Electrical and Electronic Equipment adds that electrical and electronic equipment produced domestically, imported, excluding electrical wires and cables with voltage below 50V or above 1000V, must be certified following the relevant safety requirements outlined in Section 2 (providing additional information for electrical wires and cables with voltage from 50V) of this Regulation, bear the conformity mark (CR), and implement management measures as per current regulations before being marketed.

b) Conformity certification for electrical and electronic devices

  • Electrical and electronic devices must be assessed and certified for conformity according to Method 5, which involves “testing representative samples and evaluating the production process, monitoring through sample testing taken at the production site or in the market, combined with evaluating the production process,” as specified in Appendix II of Decision No. 24/2007/MOST issued on 28/10/2007. The conformity certificate issued under Method 5 is valid for no more than three (3) years.

  • Imported electrical and electronic devices that have not been assessed and certified for conformity according to Method 5 must be evaluated and certified according to Method 7, “testing and evaluating product batches,” as stipulated in Appendix II of Decision No. 24/2007/MOST. The conformity certificate issued under Method 7 is valid only for the specific batch of imported goods.
  • Recognition of the conformity assessment results from foreign conformity assessment bodies is carried out following the provisions of Circular No. 27/2007/MOST dated October 31, 2007, which guides the signing and implementation of agreements and mutual recognition arrangements for conformity assessment results. The certification body must ensure the competence of the conformity assessment body meets the requirements and report to the Directorate for Standards, Metrology, and Quality for review and management.

c) Conformity Certification Body

  • Conformity certification must be carried out by a designated or recognized certification body as stipulated in Circular No. 09/2009/MOST dated April 8, 2009. 

  • The designation of foreign conformity assessment bodies for evaluating the conformity of electrical and electronic devices is carried out in accordance with the provisions of Circular No. 26/2013/MOST dated November 15, 2013.

d) Using Conformity Certification Mark (CR)

The conformity mark and its use must comply with Clause 2, Article 4 of the “Regulations on Conformity Certification, Conformity Assessment, and Declaration of Conformity” issued with Decision No. 24/2007/MOST dated September 28, 2007.

e) Registration

Manufacturers of electrical and electronic devices, after obtaining the conformity certification, must register the declaration of conformity at the Standards and Quality Measurement Sub-Department where the business is registered before circulating the product on the market, in accordance with the provisions of Circular No. 28/2012/MOST dated December 12, 2012 (Registration documents must comply with Article 14 of the Circular).

After obtaining the conformity certification, importers of electrical and electronic devices must register for quality inspection at the Standards and Quality Measurement Sub-Department following the provisions of Circular No. 28/2012/MOST dated December 12, 2012 (Registration documents must comply with Article 6 of the Circular).

III. EFFECTIVE DATE

According to Circular No. 21/2009/MOST – QCVN 04:2009/MOST/Amendment 01:2016

  • From June 1, 2010, electrical and electronic devices listed from number 1 to number 6 in the Annex of the National Technical Regulation on Safety for Electrical and Electronic Devices may only be circulated in the market after being certified for conformity, marked with the conformity mark, and registered for quality documentation as prescribed. 

  • From January 1, 2011, electrical and electronic devices listed from number 7 to number 13 in the Annex of the National Technical Regulation on Safety for Electrical and Electronic Devices may only be circulated in the market after being certified for conformity, marked with the conformity mark, and registered for quality documentation as prescribed.

Amendment No. 01:2016

  • From August 1, 2008, electrical wires and cables (Item 10) produced, imported, and circulated in the market must comply with the provisions of Amendment 1:2016 QCVN 4:2009/MOST.

According to Circular No. 16/2010/MOST (amended from Circular No. 21/2009/MOST)

  • From January 1, 2011, microwave products listed as item 8 in the Appendix of QCVN 4:2009/MOST can only be circulated on the market after being certified for compliance, affixed with the compliance mark and registered for quality documentation as required.
  • From October 1, 2011, products listed as items 7, 9, 10, 11, 12, and 13 in the Appendix of QCVN 4:2009/MOST can only be circulated on the market after being certified for compliance, affixed with the compliance mark, and registered for quality documentation as required.
