Circular 18/2018/TT-BTTTT Amending and Supplementing Circular No. 46/2016/TT-BTTTT

On December 20, 2018, the Ministry of Information and Communications officially promulgated Circular 18/2018/TT-BTTTT amending and supplementing a number of articles of Circular No. 46/2016/TT-BTTTT dated December 26, 2016, of the Minister of Information and Communications, which regulates the list of radio devices exempt from radio frequency-use licenses, along with accompanying technical and operational conditions. Circular 18/2018/TT-BTTTT of the Ministry of Information and Communications regarding the list of frequency license-exempt devices will take effect from February 12, 2019.

1. The Content of Circular 18/2018/TT-BTTTT

Key additions and changes:

  • Clarify the definitions of short-range radio devices, Wireless video transmission devices, and Radar sensors in transport information (Automotive Radar, Radar sensor, or Road Transport and Traffic Telematics).
  • Supplement provisions confirming that short-range radio transmitting and receiving devices that do not meet frequency conditions and technical conditions (ERP / EIRP transmit power, spurious emissions…) will not be permitted for use, production, or import for use. For short-range radio transmitting and receiving devices capable of operating in frequency bands wider than permitted, or operating at various frequencies (including prohibited frequencies), or multiple power levels (including levels exceeding the limit), the frequencies and power levels must be fixed in accordance with the regulations of this Circular prior to import.
  • Remove the 866 ~ 868 MHz license-exempt band previously allocated for Radio Frequency Identification (RFID) devices. RFID devices in the 866 ~ 868 MHz range imported and put into use before the effective date of Circular 18/2018/TT-BTTTT may continue to be used, provided that use must cease if harmful interference is caused to licensed radio devices.
  • Add the bands 3.234 MHz ~ 5.234 MHz and 26.957 MHz ~ 27.283 MHz specifically for intelligent railway systems (metro, elevated trains).
  • High-power 918 ~ 923 MHz RFID readers specifically for electronic toll collection (ETC) systems and wireless audio devices specifically for broadcasting and television are removed from the list of short-range radio devices (they may be imported with high power levels but must obtain a radio frequency license before use).
  • Extend the frequency range permitted for wireless charging devices from 145 kHz up to 190 kHz.
  • Add international standard frequencies for certain specialized maritime equipment such as Automatic Identification Systems (AIS), Emergency Position Indicating Radio Beacons (EPIRB), and Search and Rescue Transponders (SART).

2. Effectiveness

The Circular 18/2018/TT-BTTTT is effective from February 12, 2019.
