I. SUBJECTS OF APPLICATION
Circular No. 02/2024/TT-BTTTT applies to:
- Organizations and individuals involved in the production and business of products and goods on the List of Category 2 products and goods in Vietnam.
- Organizations and individuals involved in activities related to the quality management of products and goods on the List of Category 2 products and goods in Vietnam.
II. MAIN CONTENTS OF CIRCULAR NO. 02/2024/TT-BTTTT
Circular No. 02/2024/TT-BTTTT introduces many changes aimed at supporting enterprises, including the following prominent contents:
- Test results from domestic or foreign laboratories that have not been designated or recognized, or test results from manufacturers, shall not be used to assess conformity with this technical regulation.
- Regarding QCVN 132:2022/BTTTT: In cases where products or goods use a voltage converter (adapter), if the adapter is included, test QCVN 132:2022/BTTTT for the product/goods along with the adapter; if the adapter is not included, test QCVN 132:2022/BTTTT for the product/goods without the adapter.
- Exemption from certification of conformity for certain cases of import for self-use – a maximum of 3 (three) products/goods of each type per shipment may be imported. These products/goods must have operating frequency bands and technical specifications that meet the conditions of Circular No. 08/2021/TT-BTTTT dated October 14, 2021.
- Allowing the earlier application of new regulations QCVN 55:2023/BTTTT, QCVN 110:2023/BTTTT, and QCVN 111:2023/BTTTT starting from May 15, 2024.
- Manufacturers and importing companies may choose to comply with one of the following three circulars: Circular No. 04/2023/TT-BTTTT and Circular No. 10/2023/TT-BTTTT, or according to the provisions in Circular No. 02/2024/TT-BTTTT. Complete the dossiers for declaration of conformity, certification of conformity, and quality inspection registration during the period from January 1, 2024, until before the date Circular No. 02/2024/TT-BTTTT takes effect.
- Certificates of conformity issued during the partial or total suspension period (July 15, 2023 – May 14, 2024) will continue to be valid until the expiration date stated on the certificate.
- Accepting the use of Chassis test results for the declaration of conformity according to QCVN 63:2020/BTTTT, subject to certain additional documentation requirements.
- Mandatory support for the frequency bands specified in QCVN 127:2021/BTTTT, and mandatory support for both Standalone (SA) and Non-Standalone (NSA) operating modes for 5G mobile phones.
III. EFFECTIVE DATE
Circular No. 02/2024/TT-BTTTT requires quality inspection, certification of conformity, and declaration of conformity for radio transceiver and information technology products. It takes effect from May 15, 2024, replacing Circular No. 04/2023/TT-BTTTT. Compared to the previous version, this Circular No. 02/2024/TT-BTTTT is a version that includes many new contents, not just limited to amendments and supplements.
