I. SUBJECTS OF APPLICATION FOR CIRCULAR NO. 34/2020/TT-BTTTT – QCVN 74:2020/BTTTT
Circular No. 34/2020/TT-BTTTT along with QCVN 74:2020/BTTTT applies to Vietnamese and foreign agencies, organizations, and individuals engaged in the production and business of equipment within the scope of this Regulation (see more in Section III) throughout the territory of Vietnam.
II. MAIN CONTENT OF CIRCULAR NO. 34/2020/TT-BTTTT
- On November 6, 2020, the Ministry of Information and Communications (MIC) issued Circular No. 34/2020/TT-BTTTT accompanying QCVN 74:2020/BTTTT regarding Short Range Devices in the 1 GHz to 40 GHz band.
- This Circular stipulates that QCVN 74:2020/BTTTT replaces the provisions in Clause 6, Article 1 of Circular No. 16/2013/TT-BTTTT (i.e., QCVN 74:2013/BTTTT) as of July 1, 2021.
- The Chief of Office, Director General of the Department of Science and Technology, heads of agencies and units under the Ministry of Information and Communications, Directors of the Departments of Information and Communications of provinces and centrally-run cities, and relevant organizations and individuals are responsible for implementing this Circular.
III. MAIN CONTENT OF QCVN 74:2020/BTTTT
QCVN 74:2020/BTTTT is applied to replace the National Technical Regulation QCVN 74:2013/BTTTT, regulating short range radio equipment in the 1 GHz to 40 GHz band.
1. Scope of Regulation
This Regulation applies to the following types of Short Range Devices (SRD):
- Non-specific short-range radio transceivers: alarms, controls, telemetry, data transmission, etc.;
- Radio Frequency Identification (RFID) equipment;
- Radio determination equipment: object detection devices, object movement, and remote warning or alarm applications.
This Regulation applies to products and goods that are short range radio devices in the 1 GHz to 40 GHz band with HS codes specified in Appendix D, including:

All short range radio devices must comply with Vietnam’s frequency planning and frequency channeling regulations. The types of radio equipment listed above operating in the 1 GHz to 40 GHz band (as specified in Table 1) apply to cases involving:
- Having an output connection (RF) with a separate antenna (detachable antenna) or an antenna integrated within the radio transceiver (integrated antenna);
- All different types of modulation;
- Voice or non-voice applications.

This Regulation applies to fixed stations, mobile stations, and portable stations, and does not apply to applications using UWB technology.
2. Technical Regulations QCVN 74:2020/BTTTT
QCVN 74:2020/BTTTT regarding Short Range Devices in the 1 GHz to 40 GHz band provides the following technical requirements:
– Environmental condition requirements specify: “The technical requirements of this regulation apply within the environmental operating conditions of the equipment as announced/declared by the manufacturer. This equipment must comply with all technical requirements of this regulation when operating within the boundaries of the declared environmental operating conditions.”
– Requirements for testing compliance with technical requirements, including: Environmental conditions for testing; Testing equipment; Mechanical and electrical design; Auxiliary testing equipment; Testing power source; Standard testing conditions; General conditions and Interpretation of measurement results.
– Requirements for transmitters, including: Measurement requirements for transmitters; Equivalent Isotropic Radiated Power (e.i.r.p.); Permitted operating frequency range; Unwanted emissions in the spurious domain; Duty cycle; and Additional requirements for FHSS equipment.
– Requirements for receivers, including: Receiver category; General performance criteria; Adjacent channel selectivity; Blocking; and Spurious radiation.
3. Management Regulations
– Short range radio devices in the 1 GHz to 40 GHz band within the scope defined in Section 1 (equivalent to Section 1.1 of the regulation) must comply with the technical regulations in this standard.
– Measurement/testing for the technical requirements specified in 2.4.3 (technical requirements for Adjacent channel selectivity) and 2.4.4 (technical requirements for Blocking) of this Regulation shall be performed by a designated domestic testing laboratory, a recognized foreign testing laboratory, or domestic and foreign laboratories accredited to ISO 17025 standards, or the manufacturer’s own measurement/testing results.
– Measurement/testing for the technical requirements specified in this Regulation (except for 2.4.3 and 2.4.4) shall be performed by a designated domestic testing laboratory or a recognized foreign testing laboratory.
⇒ Related organizations and individuals are responsible for implementing the regulations on conformity certification and declaration of conformity for short range radio devices in the 1 GHz to 40 GHz band and are subject to inspection by state management agencies according to current regulations.
IV. EFFECTIVE DATE
Circular No. 34/2020/TT-BTTTT (QCVN 74:2020/BTTTT) takes effect from July 1, 2021.
