Circular No. 38/2020/TT-BTTTT - QCVN 122:2020/BTTTT on Low Power Wide Area Network (LPWAN) Radio Equipment in the 920 MHz to 923 MHz Band

I. SUBJECTS OF APPLICATION FOR CIRCULAR 38/2020/TT-BTTTT AND QCVN 122:2020/BTTTT

Circular No. 38/2020/TT-BTTTT (including QCVN 122:2020/BTTTT) applies to Vietnamese and foreign organizations and individuals involved in the production and business of equipment within the scope of this Regulation on Vietnamese territory.

The HS codes for Low Power Wide Area Network (LPWAN) radio equipment in the 920 MHz to 923 MHz band are specified in Annex D of QCVN 122:2020/BTTTT as follows:

II. MAIN CONTENT OF CIRCULAR NO. 38/2020/TT-BTTTT

Promulgated together with this Circular is the National Technical Regulation on Low Power Wide Area Network (LPWAN) radio equipment in the 920 MHz to 923 MHz band (QCVN 122:2020/BTTTT).
The Chief of Office, the Director General of the Department of Science and Technology, heads of agencies and units under the Ministry of Information and Communications, Directors of the Departments of Information and Communications of provinces and centrally-run cities, and relevant organizations and individuals are responsible for the implementation of this Circular.

III. MAIN CONTENT OF QCVN 122:2020/BTTTT

This Regulation specifies technical indicators regarding the frequency spectrum, technical conditions, and measurement methods for radio equipment in Low Power Wide Area Networks (LPWAN) operating in the 920 MHz to 923 MHz band.
LPWAN radio equipment includes sensors (Sensors or Endpoints) and access devices (Access stations or Gateways) connected via a radio interface; utilizing a shared frequency spectrum (920 MHz to 923 MHz band) with other short-range radio devices.
LPWAN radio equipment utilizing licensed spectrum for public mobile information (IMT) is not within the scope of this Regulation.
Measurement/testing for the technical requirements in QCVN 122:2020/BTTTT (except for section 2.4.9) must be conducted by a designated domestic laboratory or a recognized foreign laboratory.
For the technical requirements specified in section 2.4.9 of this Regulation, organizations and individuals are permitted to use test results from designated domestic labs, recognized foreign labs, domestic or foreign labs accredited to ISO/IEC 17025 standards, or the manufacturer’s own test results.
Relevant organizations and individuals are responsible for implementing regulations on conformity certification and declaration for LPWAN radio equipment in the 920 MHz to 923 MHz band and are subject to inspection by state management agencies according to current regulations.

IV. EFFECTIVE DATE OF CIRCULAR 38/2020/TT-BTTTT AND QCVN 122:2020/BTTTT

Starting from July 01, 2021, Circular 38/2020/TT-BTTTT and QCVN 122:2020/BTTTT officially came into force. Low Power Wide Area Network (LPWAN) radio devices in the 920 MHz to 923 MHz band with HS codes specified in Annex D of the regulation must comply with the provisions of this Regulation.
