I. SUBJECTS OF APPLICATION
Compared to Circular No. 30/2011/TT-BTTTT, the new Circular has no new amendments or supplements regarding the subjects of application. Vietnamese and foreign organizations and individuals involved in manufacturing and trading products and goods under the specialized management of the Ministry of Information and Communications, including: telecommunications equipment; radio transmitting and receiving equipment; electronic and information technology equipment (except for equipment used for defense and security purposes as prescribed by law), shall continue to comply with the provisions of this Circular.
II. CONTENT OF CIRCULAR NO. 15/2018/TT-BTTTT AMENDING AND SUPPLEMENTING CIRCULAR NO. 30/2011/TT-BTTTT ON CONFORMITY CERTIFICATION AND CONFORMITY DECLARATION FOR ICT PRODUCTS
The amendments and supplements to Circular 30/2011/TT-BTTTT include:
- Supplementing information on the definition of testing units serving the Conformity Declaration for ICT Products;
- Amending and supplementing the list of products and goods, management forms, and cases exempt from quality inspection upon importation;
- Amending the regulations on the time for the certification body to evaluate and issue the certificate of conformity to no more than 07 working days from the receipt of a complete and valid dossier (a reduction of 03 days);
- Amending and supplementing regulations on certification of conformity, including: methods of certification, dossiers for certification of conformity, measures for Conformity Declaration for ICT Products, and re-implementation of conformity declaration;
- Amending and supplementing the processes and procedures for Conformity Declaration for ICT Products;
- Amending and supplementing the dossier for Conformity Declaration for ICT Products and regulations on submitting dossiers to the Authority of Telecommunications by organizations and individuals;
- Amending and supplementing the validity and procedures for re-issuance of the certificate of conformity;
- Replacing the “Request form for certification of conformity” in Appendix II with Form No. 01; the “Conformity Declaration for ICT Products form” in Appendix III with Form No. 02; the “Notice of receipt of the Conformity Declaration for ICT Products” in Appendix IV with Form No. 03 in the Appendix issued together with this Circular;
- Abolishing Clause 8 Article 2, Clause 3 Article 5, Clause 3 Article 13, Point a Clause 1 Article 23; Points d and dd Clause 1 Article 27 of Circular No. 30/2011/TT-BTTTT.
III. EFFECTIVENESS
Circular No. 15/2018/TT-BTTTT takes effect from January 01, 2019. In addition, the Ministry of Information and Communications has issued Circular 10/2020/TT-BTTTT (effective from July 01, 2020) to further supplement and amend Circular No. 30/2011/TT-BTTTT regarding certification of conformity and Conformity Declaration for ICT Products.
