Official Declaration: Energy Labeling for Commercial Refrigerators

Enterprises that import, manufacture, and trade commercial refrigerators equipment are responsible for conducting energy efficiency testing and making the energy labeling declaration before bringing products to market. 1. Regulations on Energy Efficiency and Energy Labeling

Circular No. 36/2016/TT-BCT – Regulating energy labeling for energy-using vehicles and equipment under the management scope of the Ministry of Industry and Trade, issued on December 28, 2016;
Decision No. 04/2017/QĐ-TTG – List of means and equipment required to have energy labels, applying minimum energy efficiency levels and the implementation roadmap, issued by the Prime Minister on March 9, 2017;
Circular No. 42/2019/TT-BCT – Amending regulations on the periodic reporting regime in Circulars issued by the Minister of Industry and Trade on December 18, 2019;
Consolidated Document No. 23/VBHN-BCT – Regulating energy labels for energy-using vehicles and equipment under the management scope of the Ministry of Industry and Trade, issued on March 24, 2020;
Decision No. 14/2023/QĐ-TTg – List and roadmap for energy-using vehicles and equipment to be eliminated and low-efficiency power generator units not to be newly built, issued by the Prime Minister on May 24, 2023;
Decision No. 1725/QĐ-BCT – Regulating the List of goods subject to energy efficiency testing and energy labeling under the management responsibility of the Ministry of Industry and Trade, issued on July 1, 2024;
TCVN 10289:2014 – National standard on energy efficiency for Commercial Refrigerators.

2. Types of Commercial Refrigerators Requiring Energy Labels

According to Decision No. 14/2023/QĐ-TTg, effective April 1, 2025, commercial refrigerators must undergo energy efficiency testing and energy labeling in accordance with the standard:

TCVN 10289:2014 – regarding Commercial Refrigerators – Energy efficiency

This standard specifies the energy efficiency levels for commercial refrigerators used for the sale and display of foodstuffs (hereinafter referred to as refrigerating appliances).

Note: This standard does not apply to vending machines.

3. Declaration of Energy Labeling for Commercial Refrigerators

Based on Decision No. 14/2023/QĐ-TTg and Decision No. 04/2017/QĐ-TTg, commercial refrigerators are mandatorily required to undergo energy efficiency testing and complete the declaration of energy labeling before being introduced to the market. Accordingly, the declaration of energy labeling consists of the following steps:

3.1. Energy Efficiency Testing for Energy Labeling for Commercial Refrigerators

The test result serves as the basis for applying the energy label to products of the same model (sharing the same technical specifications, origin, and manufacturer). Consequently, enterprises that manufacture or import commercial refrigerator are responsible for conducting energy efficiency testing to finalize the dossier for the energy labeling declaration.

Types of commercial refrigerators are required to be tested for energy efficiency according to TCVN 10289:2014. This Equipment must meet the energy efficiency requirements for refrigerating appliances (per 3.7), which are divided into two levels: minimum and high. The energy efficiency, when determined according to TCVN 10290, must comply with Table 1 or Table 2 of TCVN 10289:2014, as applicable.

Note: Enterprises must conduct energy efficiency testing at domestic testing organizations (which can be independent testing organizations or the manufacturer’s own laboratory) or foreign testing organizations (independent testing organizations or a manufacturer’s laboratory) that are designated by the Ministry of Industry and Trade.

This falls under the state management responsibility of the Ministry of Industry and Trade (MOIT) for household and office electrical-electronic equipment (including commercial refrigerators).

3.2. Declaration of Energy Labeling for Commercial Refrigerators at the Ministry of Industry and Trade

3.2.1 Case of New Registration

Step 1: Prepare the Registration Dossier

Before bringing commercial refrigerators to the market, the manufacturing or importing enterprise must prepare one (01) complete dossier for energy labeling registration and submit it to the Ministry of Industry and Trade.

Pursuant to Clause 2, Article 5 of Circular No. 36/2016/TT-BCT, which regulates energy labeling registration, the registration dossier for Energy Labeling for Commercial Refrigerators includes:

a) The declaration paper of energy labeling for commercial refrigerators, which must clearly state whether the enterprise is registering for a comparative label or a confirmation label, following the template in Appendix 1 of Circular No. 36/2016/TT-BCT;

b) The test result issued by the testing organization for the specific product model;

c) The intended energy label sample.

Note:

For cases where the testing for Energy Labeling for Commercial Refrigerators is conducted by a foreign testing organization, the enterprise must provide additional documentation proving the foreign laboratory has met all required conditions.
If the dossier and documents are in a foreign language, they must be translated into Vietnamese and notarized.

Step 2: Registration

Enterprises registering for energy labeling of commercial refrigerators may select the submission method: either via the internet through the Ministry of Industry and Trade’s official e-portal (https://dichvucong.moit.gov.vn/) or by submitting the dossier directly or via postal service to the Agency of Innovation, Green Transformation and Industrial Promotion, Ministry of Industry and Trade.

Step 3: Post-Registration

After submitting the registration dossier for Energy Labeling for Commercial Refrigerators to the Ministry of Industry and Trade, the enterprise is permitted to self-implement the energy labeling that corresponds to the information in the Declaration of energy labeling for the registered product. The enterprise must bear full responsibility for the accuracy and truthfulness of the information declared in the Declaration of energy labeling and the information displayed on the energy label.

3.2.2 Case of Re-Registration for Energy Labeling

An enterprise must re-register for Energy Labeling for Commercial Refrigerators if one of the following situations occurs:

The evaluation standard changes;
The product or equipment that has already been registered for energy labeling undergoes changes in its energy consumption level.
