Decree 74/2018/NĐ-CP Prescribing the Implementation of the Law on Quality of Commodities

At the request of the Minister of Science and Technology, the Government promulgated the Decree amending and supplementing a number of articles of the Government’s Decree No. 132/2008/NĐ-CP detailing the implementation of a number of articles of the Law on Quality of Products and Goods on May 15, 2018.

1. Contents of amendments and supplements to a number of articles according to Decree 74/2018/NĐ-CP

Decree 74/2018/NĐ-CP amends and supplements articles of Decree No. 132/2008/NĐ-CP on guidelines for the Law on Product and Goods Quality; including the following edits:

Amending Article 3 – Products and goods capable of causing insecurity;
Supplementing Point c, Clause 1 and amending Clause 2, Article 4 – Products and goods capable of causing insecurity;
Supplementing Article 7 – Conditions for ensuring the quality of imported goods before being put on the market, including: Point c, Clause 1; amending Clause 2 and supplementing Clause 2a; Clause 2b; Clause 2c; Clause 6; Clause 7; Clause 8; Clause 9;
Amending Clause 2, Article 12 – Quality inspection of goods circulating on the market;
Amending Clause 3, Article 13 – Handling of violations during the quality inspection of goods circulating on the market, supplementing Article 13a and Article 13b;
Amending Article 17 – Conformity assessment organizations and registration of conformity assessment activities;
Amending Article 18 – Designation of conformity assessment organizations and recognition of conformity assessment results and supplementing Articles 18a, 18b, 18c, 18d, 18đ, 18e, 18g;
Supplementing Section 7 of Chapter II “State management of codes and barcodes” and supplementing Articles 19a, 19b, 19c, 19d;
Amending Point b, Clause 1, Article 21 – Assignment of responsibility for quality inspection of products and goods to inspection agencies under line ministries and sectors;
Amending Clause 2 and abolishing Clause 3, Article 22 – Quality inspectors;
Amending Article 25 – Forms of awards;
Amending Article 27 – Award criteria and supplementing Articles 27a, 27b, 27c;
Amending Article 28 – Awarding process and dossiers;
Amending Article 29 – Operational funding;
Amending Article 30 – Rights of winning organizations and enterprises and supplementing Article 30a;
Amending Article 31 – Responsibilities of the Ministry of Science and Technology for state management of product and goods quality;
Amending Article 32 – Responsibilities of line ministries and sectors for state management of product and goods quality;
Amending Clause 2, Article 33 – Responsibilities of People’s Committees at all levels.

2. Implementation provisions

Decree 74/2018/NĐ-CP is effective from July 01, 2018.
Other regulations on the designation of conformity assessment organizations, National Quality Awards, and codes and barcodes in legal documents of the same level and lower than this Decree shall cease to be effective as of July 01, 2018.
Decisions designating conformity assessment organizations by line ministries and sectors that are still valid shall continue to be maintained until the expiration of the validity period stated in the designation decision.
