Guidance on Testing and Regulatory Conformity Certification of LED Lamps According to QCVN 19:2019/BKHCN

I. APPLICABLE CURRENT REGULATIONS:

Phuc Gia Lab – The regulations, guidelines, and necessary documents for the Declaration of Conformity for LED lights are governed by the following documents from the Ministry of Science and Technology:

  • Circular No. 08/2019/TT-BKHCN: The Circular promulgating the “National Technical Regulation on LED Lighting Products,” issued on September 25, 2019 (This Circular took effect on December 31, 2019);
  • QCVN 19:2019/BKHCN: National Technical Regulation on LED Lighting Products (promulgated in conjunction with Circular 08/2019/TT-BKHCN);
  • Decision No. 1383/QĐ-BKHCN: Correction of the National Technical Regulation QCVN 19:2019/BKHCN regarding LED lighting products;
  • Decision No. 2711/QĐ-BKHCN: On the Announcement of Group 2 Products and Goods under the Management Responsibility of the Ministry of Science and Technology, issued on December 30, 2022;
  • Decision No. 367/QĐ-BKHCN: Amending and supplementing the Group of LED Lighting Products in Decision No. 2711/QĐ-BKHCN.

II. GUIDELINES FOR TESTING AND CONFORMITY CERTIFICATION OF LED LAMPS ACCORDING TO QCVN 19:2019/BKHCN

Based on the requirements of Circular 08/2019/TT-BKHCN dated September 25, 2019, and QCVN 19:2019/BKHCN – the national technical regulation for LED lighting products, Phuc Gia Testing Laboratory provides guidance for enterprises to conduct testing and declaration of conformity with the following details:

1. Where to conduct LED lamp conformity testing according to QCVN 19:2019/BKHCN?

Phuc Gia Testing Laboratory is designated by the Ministry of Science and Technology to test all testing indicators (Electrical Safety, Electromagnetic Interference – EMI, Electromagnetic Immunity – EMS, Photobiological Safety – PBS) for both stages of QCVN 19:2019/BKHCN.

On October 28, 2021, Phuc Gia Testing Laboratory was granted a decision by the Directorate for Standards, Metrology and Quality – Ministry of Science and Technology regarding the Designation of the Testing Organization for QCVN 19:2019/BKHCN for the second time (updating additional indicators for Stage 2 of QCVN 19:2019/BKHCN). Accordingly, Phuc Gia Testing Laboratory is one of the very few testing laboratories with full equipment, machinery, trained personnel, as well as being evaluated and designated to perform full testing of all strict indicators of the national technical regulation QCVN 19:2019/BKHCN for LED lighting products in accordance with current legal regulations related to product and goods quality management under Decision No. 2483/QD-TDC dated December 25, 2020.

On December 13, 2022, the Directorate for Standards, Metrology and Quality – Ministry of Science and Technology issued a Decision designating the testing organization for Phuc Gia Lab to perform multi-disciplinary testing activities in the electrical – electronic field, including technical indicators for electrical safety (ES) and electromagnetic compatibility (EMC), Electromagnetic Immunity, and Photobiological Safety for lighting products in accordance with the national technical regulation QCVN 19:2019/BKHCN and current legal regulations related to product and goods quality management under Decision No. 2117/QD-TDC for the corresponding products, goods, and tests in the attached Appendix (Relocated to: Phuc Gia Testing and Inspection Center – Long Bien ICD, No. 01 Huynh Tan Phat, Sai Dong B Industrial Park, Long Bien Ward, Long Bien District, Hanoi City, Vietnam).

2. Why is it necessary to test, certify, and declare conformity for LED lamps and register for State Inspection for LED lamps, LED lighting products, and what are the specific requirements?

Based on Article 3 – Management Requirements – Circular 08/2019/TT-BKHCN, accordingly: “LED lighting products in the Appendix of this Technical Regulation must have a declaration of conformity consistent with technical regulations, bear the conformity mark (CR mark), and be labeled before being circulated on the market.”

Specific requirements for testing, declaration, and certification of conformity for LED lamps according to QCVN 19:

a. LED lamp conformity testing:

Testing to serve the declaration of conformity and certification of conformity for LED lamps must be performed by testing organizations designated under the provisions of Decree No. 107/2016/ND-CP, Decree No. 154/2018/ND-CP, or recognized under the provisions of Circular No. 27/2007/TT-BKHCN (The testing scope of the testing organization must meet the requirements specified in this Technical Regulation).

b. LED lamp declaration of conformity (For products manufactured Domestically):

  • Scope of application: Domestically manufactured LED lighting products
  • Current regulations: Circular No. 28/2012/TT-BKHCN and Circular No. 02/2017/TT-BKHCN
  • Basis for performing declaration of conformity: The declaration of conformity must be based on the certification results of a certification organization that has registered its field of activity according to the provisions of Decree 107/2016/ND-CP, Decree No. 154/2018/ND-CP, or is recognized according to the provisions of Circular No. 27/2007/TT-BKHCN.
  • LED lamp manufacturing enterprises, after being certified for conformity, must register the declaration of conformity at the Department of Standards, Metrology and Quality where the enterprise is registered for business according to the provisions of Circular No. 28/2012/TT-BKHCN and Circular No. 02/2017/TT-BKHCN of the Minister of Science and Technology.

c. LED lamp conformity certification (For imported products):

  • Scope of application: Imported LED lighting products
  • Certification method: Certification is performed according to Method 1 (typical sample testing)
  • Current regulations: Appendix II of Circular No. 28/2012/TT-BKHCN and Circular No. 02/2017/BKHCN.
  • Testing: Testing for certification must be performed by a testing organization designated under the provisions of Decree No. 107/2016/ND-CP, Decree No. 154/2018/ND-CP, or recognized under the provisions of Circular No. 27/2007/TT-BKHCN (The testing scope of the testing organization must meet the requirements specified in this Technical Regulation).
  • Validity of the Conformity Certificate: Valid for no more than 3 years.

d. State Inspection Registration for LED lamps

  • Scope of application: Imported LED lighting products
  • Current regulations: Circular No. 27/2012/TT-BKHCN and Circular No. 07/2017/TT-BKHCN
  • LED lamp importing enterprises, after being certified for conformity, must register for quality inspection at the inspection agency according to the provisions of Circular No. 27/2012/TT-BKHCN dated February 12, 2012, and Circular No. 07/2017/TT-BKHCN dated June 16, 2017, of the Minister of Science and Technology.

3. Which types of LED lighting equipment are NOT within the scope of QCVN 19:2019/BKHCN?

Based on Section 1.1 – Scope of Regulation of QCVN 19:2019/BKHCN, the following products are NOT within the scope of QCVN 19:2019/BKHCN:

a. LED lighting equipment on transportation vehicles specified in QCVN 35:2017/BGTVT

Example: Front headlights of mopeds, motorcycles, and automobiles.

b. LED lighting devices in lighting works as specified in QCVN 07-7:2016/BXD

Example: Lighting devices for urban traffic roads, urban centers, concentrated residential areas, and public spaces (public playgrounds, squares, parks, and flower gardens); devices in lighting works include: Substations, lamp posts, wiring systems, control cabinets, and lighting fixtures.

c. Lighting devices in outdoor advertising media as specified in QCVN 17:2018/BXD

Example: Billboards, lightboxes; specialized outdoor advertising screens; signs; advertising media in the form of letters, images, or symbols.

4. Implementation roadmap for testing and declaration of conformity for LED lamps according to Circular No. 08/2019/TT-BKHCN and Decision No. 1383/QD-BKHCN?

Application date: According to the roadmap of June 1, 2020, and June 1, 2021 (According to Circular No. 08/2019/TT-BKHCN).

Based on Article 4 – Circular No. 08/2019/TT-BKHCN, the roadmap for applying QCVN 19 is specified in detail as follows:

  • From June 1, 2020, domestically produced and imported products specified in the Appendix issued with QCVN 19:2019/BKHCN must meet the requirements for safety and electromagnetic interference (EMI) limits specified in Sections 2.1.1; 2.1.2; 2.1.3, and 2.2.1 of QCVN 19:2019/BKHCN before being circulated on the market.
  • From June 1, 2021, products specified in the Appendix issued with QCVN 19:2019/BKHCN must meet all requirements specified in Section 2 of QCVN 19:2019/BKHCN before being circulated on the market.

However, the roadmap for implementing testing and declaration of conformity for LED lamps was pushed back and is detailed in Decision No. 1383/QD-BKHCN, specifically as follows:

The application date was corrected and readjusted: According to the roadmap of January 1, 2021, and January 1, 2022 (According to Decision No. 1383/QD-BKHCN).

From January 1, 2021, domestically produced and imported products specified in the Appendix issued with QCVN 19:2019/BKHCN must meet the requirements for safety and electromagnetic interference (EMI) limits specified in Sections 2.1.1; 2.1.2; 2.1.3, and 2.2.1 of QCVN 19:2019/BKHCN before being circulated on the market.

  • Enterprises, organizations, and individuals manufacturing or importing LED lighting products are encouraged to apply the regulations of QCVN 19:2019/BKHCN starting from the effective date of this Circular.

III. FREQUENTLY ASKED QUESTIONS:

Q1: Where do we need to send samples for testing, and how long does the testing process take?

A: Testing time: 05-15 working days from the date we receive the samples.

Q2: If there are 10 models within one product group, what will the testing and certification costs be?

A: If within one product group you can prove these models share the same main components, we can assist you by testing one representative model and issuing certificates for all 10 models in that group.

(Costs you need to pay: 01 testing fee, 10 certification fees)

However, if the main components of the 10 models in one group are different, you must test all 10 models, and we will issue certificates for all 10 models in that group.

(Costs you need to pay: 10 testing fees, 10 certification fees)

Q3: How do you need us to prove that these models share the same main components?

A: we need you to provide a list of main components, circuit diagrams, a confirmation letter (issued by the manufacturer), and for each product group, you need to send us one sample per model for physical inspection.

Q4: Regarding sample regulations: do we send the full quantity of samples for all 10 models in a group for the lab to pick one randomly, or do we only need to send the full quantity for one model?

A: For testing, you need to send all 10 models to the laboratory.

(For 9 models to be physically checked for components, you only need to send 1 sample each; for the 1 model to be tested, you must send a full quantity of 3-5 samples)

Q5: How long will it take for us to receive the certificate?

A: Testing time: 01-03 working days from the date we receive the samples.

Certification time: 02-03 working days after testing is completed and we have received all required documents.

Q6: Must LED products within the scope that were manufactured or imported before the roadmap deadline stop circulation if they do not meet QCVN 19:2019/BKHCN?

A: Based on Article 3 – Circular No. 08/2019/TT-BKHCN, products specified in the Appendix issued with QCVN 19:2019/BKHCN that were manufactured or imported before the roadmap specified in Clauses 1 and 2 of Article 4 may continue to circulate on the market until the end of June 1, 2022.
