QCVN 4:2009/BKHCN (Circular No. 21:2009/BKHCN) on Safety for Electrical and Electronic Equipment

I. SCOPE OF APPLICATION FOR QCVN 4:2009/BKHCN

QCVN 4:2009/BKHCN applies to organizations and individuals (hereinafter referred to as Enterprises) that manufacture, import, distribute, and retail electrical and electronic equipment (including: Instantaneous water heaters, Water heating and storage appliances, Hair dryers and other hair-dressing appliances, Electric kettles, Rice cookers, Electric fans, Electric irons, Microwave ovens, Electric ovens, electric griddles/grills (portable type), PVC insulated cables with a rated voltage up to and including 450/750 V, Immersion heaters, Appliances for making tea or coffee, Hand dryers), state management agencies, and other relevant organizations and individuals.

II. MAIN CONTENT

Electrical and electronic equipment are devices connected directly or via a socket to a low-voltage power source, used in households, commerce, and other similar locations (excluding medical equipment and telecommunications equipment). A low-voltage power source is an AC voltage source ranging from 50 V to 1000 V and a DC voltage source ranging from 75 V to 1500 V.

1. Safety Requirements

Electrical and electronic equipment regulated by QCVN 4:2009/BKHCN must ensure safety compliance with the corresponding national standards (TCVN) as follows: (The specific list of TCVN standards is expected to follow.)

2. Management Requirements

a) Conditions for Market Circulation

Electrical and electronic equipment circulated on the market must:

  • Have product labeling in compliance with legal regulations on product labeling.
  • Be certified for conformance (certified), bear the Conformity Mark (CR mark) as stipulated by this Technical Regulation.
  • Be subject to market inspections by the product and goods quality inspection authority (hereinafter referred to as the inspection authority).

The National Technical Regulation QCVN 4:2009/BKHCN/A1:2016 on Safety for Electrical and Electronic Equipment (amendment to QCVN 4:2009/BKHCN) additionally states that domestically manufactured and imported electrical and electronic equipment—excluding wires and cables with a voltage below $50V$ and above $1000V$—must be certified as conforming to the relevant safety requirements in Section 2 (including supplementary information for wires and cables with voltage from $50V$), bear the Conformity Mark (CR Mark), and implement management measures according to current regulations before being placed into market circulation.

b) Conformity Certification for Electrical and Electronic Equipment

  • Electrical and electronic equipment must be assessed and certified for conformity using Method 5 (as specified in Appendix II of Decision No. 24/2007/QD-BKHCN dated September 28, 2007): Method 5: “Testing of a typical sample and evaluation of the production process, surveillance through testing of samples taken at the production facility or on the market combined with evaluation of the production process.” A Conformity Certificate assessed under Method 5 has a validity period of no more than three (3) years.
  • In cases where imported electrical and electronic equipment is shipped in batches and has not been assessed and certified for conformity using Method 5, it must be assessed and certified using Method 7 (as specified in Appendix II of Decision No. 24/2007/QD-BKHCN): Method 7: “Testing and assessment of product/goods batches.” A Conformity Certificate assessed under Method 7 is only valid for that specific imported batch.
  • The recognition of certification results from foreign Conformity Assessment Bodies is conducted according to Circular No. 27/2007/BKHCN dated October 31, 2007, which guides the signing and implementation of Mutual Recognition Agreements (MRAs) on conformity assessment results. The Vietnamese certification body must ensure the competency of the foreign Conformity Assessment Body meets the requirements and report to the Directorate for Standards, Metrology, and Quality (STAMEQ) for review and management.

c) Conformity Certification Bodies

  • Conformity certification must be carried out by a designated or recognized certification body as regulated in Circular No. 09/2009/TT-BKHCN dated April 08, 2009.
  • The designation of foreign Conformity Assessment Bodies to perform conformity assessment for electrical and electronic equipment is conducted according to Circular No. 26/2013/TT-BKHCN dated November 15, 2013.

d) Use of the Conformity Mark

The Conformity Mark and its usage must comply with Clause 2, Article 4 of the “Regulation on Certification of Standard Conformity, Certification of Technical Regulation Conformity, and Announcement of Standard Conformity, Announcement of Technical Regulation Conformity” issued together with Decision No. 24/2007/QD-BKHCN dated September 28, 2007.

e) Registration

Manufacturing Enterprises: After being certified for conformity, manufacturers of electrical and electronic equipment must register their Declaration of Conformity at the local Standards, Metrology, and Quality Sub-Department (Chi cục Tiêu chuẩn Đo lường Chất lượng) where the enterprise is registered for business, before placing the products into market circulation, as stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012 (Registration documents follow Article 14 of the Circular).

Importing Enterprises: After being certified for conformity, importers of electrical and electronic equipment must register for quality inspection at the local Standards, Metrology, and Quality Sub-Department, as stipulated in Circular No. 28/2012/TT-BKHCN dated December 12, 2012 (Registration documents follow Article 6 of the Circular).

III. EFFECTIVE DATES

Based on Circular 21/2009/TT-BKHCN – QCVN 4:2009/BKHCN/A1:2016 on Safety for Electrical and Electronic Equipment:

  • From June 01, 2010: Electrical and electronic equipment listed from item 1 to item 6 in the Appendix of the National Technical Regulation on safety for electrical and electronic equipment can only be circulated on the market after being certified for conformity, bearing the Conformity Mark, and registering the quality dossier as regulated.
  • From January 01, 2011: Electrical and electronic equipment listed from item 7 to item 13 in the Appendix of the National Technical Regulation on safety for electrical and electronic equipment can only be circulated on the market after being certified for conformity, bearing the Conformity Mark, and registering the quality dossier as regulated.

First Amendment: 2016

  • From August 01, 2008: Electric wires and cables (Item 10) manufactured, imported, and circulated on the market must comply with the regulations of Amendment 1:2016 of QCVN 4:2009/BKHCN.

Based on Circular No. 16/2010/TT-BKHCN amending Circular 21/2009/TT-BKHCN:

  • From January 01, 2011: Microwave ovens (listed as item 8 in the Appendix of QCVN 4:2009/BKHCN) can only be circulated on the market after being certified for conformity, bearing the Conformity Mark, and registering the quality dossier as regulated.
  • From October 01, 2011: Products listed as items 7, 9, 10, 11, 12, and 13 in the Appendix of QCVN 4:2009/BKHCN can only be circulated on the market after being certified for conformity, bearing the Conformity Mark, and registering the quality dossier as regulated.
