I. WHAT IS AN ELECTRIC FAN?

An electric fan is a device driven by electricity, designed to generate airflow to serve various user needs, such as alleviating body heat, providing air extraction, ventilation, cooling, or any other air-related effect within a living space. An electric fan typically comprises several main components: the fan body which houses the speed control; the fan guard; the blades, and the oscillation mechanism. Today, these appliances are often integrated with intelligent features like remote controls, misting functions, and timers.

As technology advances, a growing variety of Electric Fan models has entered the market. The basic categories include the table fan (box fans often feature dual blades and are easily portable), the pedestal fan (a floor-standing model with adjustable height and oscillation), the ceiling fan (available as both standard and decorative models), the wall-mounted fan, the box fan (can be rectangular, square, or spherical, with a grille that directs air in multiple directions), the evaporative cooling fan, fans integrated into electronic devices, and the ventilation fan.

II. LEGAL REGULATIONS FOR ELECTRIC FANS

1. Legal Regulations for Electric Fans

Ministry of Industry and Trade Ministry of Science and Technology
Decision No. 04/2017/QĐ-TTG dated March 09, 2017, of the Prime Minister, stipulating the list of means and equipment subject to energy labeling, the application of minimum energy efficiency performance, and the implementation roadmap.

Decision No. 14/2023/QĐ-TTg dated May 24, 2023, of the Prime Minister, promulgating the list and roadmap for energy-using equipment to be eliminated and low-efficiency power generation units prohibited from new construction.

Circular No. 36/2016/TT-BCT dated December 28, 2016, of the Ministry of Industry and Trade, regulating energy labeling;

Circular No. 30/2011/TT-BCT dated August 10, 2011, of the Ministry of Industry and Trade, providing temporary regulations on the permitted content limits of certain hazardous chemical substances in electrical and electronic products.

Circular 21/2009/TT-BKHCN – QCVN 4:2009/BKHCN on Safety for electrical and electronic equipment.

Circular 21/2016/TT-BKHCN Amendment 1:2016 QCVN 4:2009/BKHCN National Technical Regulation on Safety for electrical and electronic equipment, issued on December 15, 2016.

TCVN 5699-2-80:2007 (IEC 60335-2-80:2005) on household and similar electrical appliances – safety – Part 2-80: particular requirements for fans.

Decision 3810/QĐ-BKHCN dated December 18, 2019, of the Ministry of Science and Technology on the list of goods subject to quality inspection under the management of the Ministry of Science and Technology.

Circular No. 01/2022/TT-BKHCN amending Circular No. 07/2018/TT-BKHCN and Circular No. 08/2019/TT-BKHCN, issued by the Minister of Science and Technology on February 16, 2022.

– Decision 2711/QĐ-BKHCN dated December 30, 2022, of the Ministry of Science and Technology on announcing Group-2 products and goods to all domestic and foreign units and enterprises.

Circular No. 01/2025/TT-BKHCN – Amending the Content of the Appendix Attached to Circular 08/2021/TT-BTTTT.

2. Required Permits and Procedures

Ministry of Industry and Trade Ministry of Science and Technology
– Energy efficiency testing;

– Declaration of energy efficiency labeling.

=> Affix the energy label before circulation on the market.

– Testing for the content of hazardous substances in the product.

– State registration for quality inspection of goods.

– Product testing according to QCVN 4:2009/BKHCN

– Regulation conformity certification

– Declaration of regulation conformity

– Affixing the regulation conformity mark

=> It is mandatory to register for state quality inspection, obtain regulation conformity certification, declare regulation conformity, and affix the regulation conformity label before circulation on the market.

3. Types of Electric Fans within the Scope of Application

Based on Decision No. 14/2023/QĐ-TTg, and based on the scope of application of TCVN 7826:2015, the following types of Electric Fans are required to undergo Energy Efficiency Testing and Declaration of energy labeling:

– Table Fans;

– Pedestal Fans;

– Wall-Mounted Fans;

– Ceiling Fans;

– Rechargeable Fans;

– Solar-Powered Fans…

 

Fan models for household and similar purposes, with a rated voltage not exceeding 250V for single-phase electric fans and 480V for other electric fans, must be tested according to QCVN 4:2009/BKHCN in accordance with TCVN 5699-2-80:2007 (IEC 60335-2-80:2005). Among them:

Electric Fans: Table Fan; Pedestal Fan; Wall-Mounted Fan; Window Fan; Ceiling Fan; Roof Ventilation Fan.

Other special fans (Electric fans for household and similar purposes): Table fans and box-type fans, Other types of fans (without a protective guard)

4. Mandatory Implementation Date of Legal Regulations for Electric Fans

Ministry of Industry and Trade Ministry of Science and Technology
– Based on No. 11, Section I, Appendix I, Decision No. 24/2018/QĐ-TTg, from July 10, 2018, enterprises importing, producing, and trading Electric Fans are required to conduct Energy Efficiency Testing for Electric Fans according to TCVN 7826:2007 before importing, producing, and trading.

– Based on No. 5, Section I, Appendix I, Decision No. 14/2023/QĐ-TTg, from July 10, 2018, enterprises importing, producing, and trading Electric Fans are required to conduct Energy Efficiency Testing for Electric Fans according to TCVN 7826:2015 before importing, producing, and trading.

– Based on Decision No. 04/2017/QĐ-TTG, it has been mandatory to declare Energy Labeling for Electric Fans since July 01, 2013 (according to Decision 03/2013/QĐ-TTg).

Circular 21/2009/TT-BKHCN – QCVN 4:2009/BKHCN/Amd1:2016 stipulates that electric fans shall only be circulated on the market after having been certified for regulation conformity, affixed with the conformity mark, and having registered their quality dossier in accordance with regulations, effective from June 01, 2010.

5. Regulations/Standards for Testing

a. Energy efficiency according to the following standard: TCVN 7826:2015

b. Permitted content limits of certain hazardous chemical substances in electrical and electronic products:

  • IEC 62321: Electrotechnical products – Determination of levels of six regulated substances
QCVN 4:2009/BKHCN stipulates that Electric Fan devices “must comply with Vietnam Standard TCVN 5699-2-80:2007 (IEC 60335-2-80:2005) on household and similar electrical appliances – safety – Part 2-80: particular requirements for fans.

– Additionally, some technical requirements for electric fans also apply according to TCVN 5699-1 (IEC 60335-1) – Part 1 – General requirements.

6. Important Notes in Import, Manufacturing, and Business Policies

When completing import procedures, all types of electric fans must undergo quality inspection and be affixed with an energy label.

 

– For appliances designed for use on vehicles, ships, or aircraft, additional requirements may be necessary;

– TCVN 5699-2-80:2007 does not apply to: electric fans designed specifically for industrial purposes; electric fans intended for use in locations with special environmental conditions (atmospheres containing corrosive or explosive substances)

7. Detailed Guide to Pre-Market Procedures for Product Circulation

For Imported Electric Fans

(1) Registration: Prepare and complete the official registration form for energy efficiency testing.

(2) Submission: Submit the completed testing registration form for the electric fan to the relevant Customs authority.

(3) Customs Clearance: The enterprise may either receive immediate customs clearance or complete the necessary procedures to transport the goods to a designated warehouse for preservation.

(4) Testing: A sample product is taken to an authorized laboratory to undergo testing and verification of its minimum energy efficiency.

(5) Final Clearance: Submit the official energy efficiency test results to the Customs authority to finalize the customs clearance process.

(6) Declaration: Carry out the official procedure to declare the energy label with the Ministry of Industry and Trade.

(7) Labeling: In compliance with the Legal Regulations for Electric Fans, the official energy label must be affixed to the product before it is circulated on the market.

For Domestically Produced Electric Fans

(1) Testing: The product must undergo testing to ensure it meets the minimum energy efficiency requirements.

(2) Declaration: The energy label must be officially declared with the Ministry of Industry and Trade.

(3) Labeling: The approved energy label must be affixed to every unit before it is released onto the market for sale.

For Imported Electric Fans

(1) State Quality Registration: Complete the state registration for quality inspection of goods.

(2) Declaration Transmission: Transmit the import declaration for the goods, accompanied by the quality inspection registration certificate.

(3) Customs Clearance: Finalize customs clearance procedures and transport the goods to the warehouse.

(4) Conformity Testing: The product must undergo regulation conformity testing according to the applicable Technical Regulation.

(5) Certification: Obtain the official regulation conformity certification.

(6) Declaration: Complete the declaration of regulation conformity.

(7) Marking: The regulation conformity mark must be affixed to the product before it is circulated on the market.

For Domestically Produced Electric Fans

(1) Compliance Testing: The product must be tested according to current Legal Regulations for Electric Fans (specifically QCVN 4:2009/BKHCN).

(2) Dossier Submission: Submit the complete regulation conformity certification dossier and one sample unit for inspection to the Ministry of Science and Technology.

(3) Conformity Declaration: The declaration of regulation conformity must be filed with the local Department of Standards, Metrology, and Quality.

(4) Marking: The regulation conformity label must be affixed to every product before it is released onto the market.
