I. WHAT IS A TABLET?
A Tablet is a type of smart electronic device capable of automatic data processing and control via a stylus or finger. This device includes at least one CPU, a keyboard (which can be physical or virtual), and a touchscreen display ranging from 6.5 inches to 17.4 inches. The product is designed to be mobile, features wireless connectivity, uses an internal battery as its power source, and is portable.

With a mass not exceeding 10kg, a Tablet is not classified as a Laptop/Notebook Computer. Furthermore, certain products such as interactive displays (larger than 17.4 inches and heavier than 10kg); displays used for advertising, signage, and wall-mounted Industrial PCs (fixed design, without lithium battery) are not Tablets but are often confused by customers during the import process.

Tablets can be classified based on their operating system, such as Android, iOS (iPad), or Windows, and can also be categorized by their intended use, such as for work, entertainment, or sales. These two methods provide a multi-dimensional view of how Tablets are utilized and their functionalities.

II. PROCEDURES AND LEGAL REGULATIONS FOR TABLETS IN VIETNAM

For the purpose of importing and placing Tablet models onto the market, enterprises and organizations are required to adhere to the following current Legal Regulations for Tablets in Vietnam:

3. Types of Tablets within the Scope of Application

All Tablets fall within the scope of application and can be classified according to the commonly used battery types:

  • Lithium-ion (Li-ion) Batteries
  • Lithium Polymer (Li-Po) Batteries
  • Nickel Metal Hydride (NiMH) Batteries
  • Lithium Iron Phosphate (LiFePO4) Batteries

Automatic data processing machines of the portable type, not exceeding 10 kg, comprising at least a central processing unit, a keyboard, and a display (excluding laptops, notebooks, subnotebooks), with or without one or more integrated functions:

  • Terrestrial Mobile Information Terminal
  • Fifth Generation (5G) Mobile Information Terminal
  • Broadband Data Transmission operating in the 2.4 GHz frequency band
  • 5 GHz frequency band Radio Access
  • Short-range Radio Transceiver

4. Effective Testing Regulations/Standards

5. Important Notes in Import, Manufacturing, and Business Policies

MINISTRY OF INDUSTRY AND TRADE MINISTRY OF SCIENCE AND TECHNOLOGY
Tablets are not subject to Circular No. 36/2016/TT-BCT on Energy Labeling regulations when categorized as the following types of goods:

  • Temporary import, transit, or transshipment;
  • Production or processing for export (not for domestic consumption);
  • Belonging to the field of national security and defense, state secrets, or nuclear radiation safety;
  • Non-commercial import not intended for business purposes as stipulated by law (personal baggage; gifts; goods for exhibition or trade fairs;…).

The dimensions of the Energy Label may be proportionally increased or decreased to suit the means and equipment, but must not cause confusion, obscure, or affect the information recorded on the goods label as stipulated by law (Article 6, Circular No. 36/2016/TT-BCT).

Pursuant to Article 5 of Circular No. 02/2024/TT-BTTTT, Tablets (belonging to Clause 1, Appendix II) that are integrated with short-range radio equipment (Clause 2, Appendix I, or Clause 4, Appendix II) and do not integrate other radio transmitting/receiving devices, satisfy the following requirements simultaneously:

  • Imported for use by the importing organization or individual itself;
  • Maximum import of 3 (three) products of each type per shipment;
  • The product’s operating frequency band and technical parameters meet the technical and exploitation conditions stipulated in Circular No. 08/2021/TT-BTTTT.

⇒ They are exempted from Conformity Certification and Conformity Declaration.

Concurrently, pursuant to Article 5 of Circular No. 02/2024/TT-BTTTT, imported Tablets satisfy the following requirements simultaneously:

  • Maximum import of 3 (three) products of each type per shipment;
  • There is a written commitment that the product complies with part/all of the technical regulations that require destructive sample testing, and the importer bears full responsibility for the safety of the imported product/goods.

⇒ They are exempted from Conformity Certification and Conformity Declaration for QCVN 101:2020/BTTTT, QCVN 132:2022/BTTTT, and the content of technical regulations that require destructive sample testing.

Pursuant to Article 3 of Circular 19/2024/TT-BTTTT, laptops must meet the following requirements:

  • From February 15, 2025, QCVN 134:2024/BTTTT shall be applied on a voluntary basis in testing, Conformity Certification, and Conformity Declaration.
  • From July 1, 2027, products and goods under the scope of QCVN 134:2024/BTTTT must comply (mandatory application) with this technical regulation before being placed on the market.
