Decree 229/2025/ND-CP Amending and Supplementing Articles of the Law on Radio Frequency

On August 19, 2025, the Government issued Decree 229/2025/ND-CP, amending and supplementing Clause 3, Article 87 of Decree No. 63/2023/ND-CP, which provides detailed regulations on several articles of the Law on Radio Frequency No. 42/2009/QH12, as amended and supplemented by Law No. 09/2022/QH15.

I. OVERVIEW OF DECREE 229/2025/ND-CP AMENDING AND SUPPLEMENTING ARTICLES OF THE LAW ON RADIO FREQUENCY

Decree 229/2025/ND-CP completely changes the fee for the right to use radio frequencies (from fee-bearing to completely exempt) to support telecommunications enterprises during license renewals. This Decree takes effect from the date of signing (August 19, 2025).

DECREE

AMENDING AND SUPPLEMENTING CLAUSE 3, ARTICLE 87 OF THE GOVERNMENT’S DECREE NO. 63/2023/ND-CP DATED AUGUST 18, 2023, PROVIDING DETAILED REGULATIONS ON A NUMBER OF ARTICLES OF THE LAW ON RADIO FREQUENCY NO. 42/2009/QH12, AS AMENDED AND SUPPLEMENTED BY LAW NO. 09/2022/QH15

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Radio Frequency No. 42/2009/QH12, as amended and supplemented by Law No. 09/2022/QH15;

At the proposal of the Minister of Science and Technology;

The Government hereby promulgates the Decree amending and supplementing Clause 3, Article 87 of the Government’s Decree No. 63/2023/ND-CP dated August 18, 2023, providing detailed regulations on a number of articles of the Law on Radio Frequency No. 42/2009/QH12, as amended and supplemented by Law No. 09/2022/QH15.

Article 1. Amending and supplementing Clause 3, Article 87 of the Government’s Decree No. 63/2023/ND-CP dated August 18, 2023, providing detailed regulations on a number of articles of the Law on Radio Frequency No. 42/2009/QH12, as amended and supplemented by Law No. 09/2022/QH15

“3. Organizations that have been granted a band-use license to establish a terrestrial public mobile telecommunications network which expires before September 6, 2023, shall pay the fee for the right to use radio frequencies for the remaining term of the license starting from July 1, 2023, at a rate of 0 (zero) VND, to be applied upon license re-issuance.”

Article 2. Implementation provisions

This Decree takes effect from the date of signing.

Article 3. Transitional provisions

Organizations that have been granted a band-use license to establish a terrestrial public mobile telecommunications network which expires before September 6, 2023, and have not yet been re-issued a license, shall apply the provisions in Clause 3, Article 87 of Decree No. 63/2023/ND-CP, as amended and supplemented by Article 1 of this Decree, upon license re-issuance.
