Pursuant to Circular No. 15/2020/TT-BTTTT on the promulgation of the “National Technical Regulation on Lithium Batteries for portable equipment”;

In Clause 1, Article 2 of Circular No. 15/2020/TT-BTTTT, it is clearly stated that this Circular takes effect from July 1, 2021, meaning that from July 1, 2021, enterprises are mandatory to perform Testing, Certification, and Declaration of Conformity for Lithium Batteries according to QCVN 101:2020/BTTTT.

Pursuant to Circular No. 15/2020/TT-BTTTT and QCVN 101:2020/BTTTT:

In Article 1.1 of QCVN 101:2020/BTTTT, it is clearly stated: This Regulation applies to Lithium Batteries for portable equipment, including detached Lithium batteries or those installed in mobile phones, tablets, and laptops, applied to Lithium Battery products and goods with HS codes specified in Appendix B as follows:

4. What are the subjects of application for QCVN 101:2020/BTTTT?

Pursuant to Article 1.2 of QCVN 101:2020/BTTTT: Subjects of application of the Regulation include “Vietnamese and foreign organizations and individuals engaged in manufacturing and business activities of equipment within the scope of this Regulation in the territory of Vietnam”.

=> This means that Lithium battery manufacturing plants in export processing zones are also within the scope of application of the Regulation, unless excluded by another legal document or guiding document.

5. Which laboratories are designated by the Ministry of Information and Communications to perform Lithium Battery Testing?

6. What technical requirements must Lithium Batteries for portable equipment participating in the Ministry of Information and Communications’ management program ensure?

Pursuant to Section 3 – Management Regulations, it is clearly stated that “Lithium Batteries within the scope of regulation specified in Article 1.1 must comply with the technical regulations in QCVN 101:2020/BTTTT and must perform declaration of conformity according to the regulation.”

In which:

  • Measurement/testing for the technical requirements of Article 2.6 is performed by a designated domestic laboratory or a recognized foreign laboratory.
  • For technical requirements other than Article 2.6 in this Regulation, organizations and individuals are permitted to use measurement/testing results from a designated domestic laboratory, a recognized foreign laboratory, domestic or foreign laboratories accredited to ISO 17025 standards, or the manufacturer’s measurement/testing results.

7. How many samples does an enterprise need to bring to the Laboratory for Testing for Lithium Batteries according to QCVN 101:2020/BTTTT?

To perform Testing for Lithium Batteries according to QCVN 101:2020/BTTTT, the minimum number of samples required to be provided to the Laboratory includes:

  • For Polymer Batteries: minimum 22 Batteries (Packs) + 38 Cells.

  • For Batteries, customers need to send an additional 5 – 10 connectors.
  • Provide technical documents related to the Batteries/Cells.

11) Modifications in QCVN 101:2020/BTTTT compared to QCVN 101:2016/BTTTT?

1. Basis of compilation QCVN 101:2020/BTTTT was compiled based on IEC 61960-6:2011 and IEC 62133:2012 QCVN 101:2016/BTTTT was compiled based on IEC 61960-3:2017 and TCVN 11919-2:2017 (IEC 62133-2:2017)
2. Testing criteria Pursuant to Circular No. 11/2020/TT-BTTTT, it is regulated: “For QCVN 101:2016/BTTTT, only the requirements for safety characteristics specified in Article 2.6 of the regulation apply; it is not mandatory to declare conformity for the transport requirements stated in Article 2.6.2.7 of the regulation.”

=> Therefore, to declare conformity, enterprises only need to perform measurement/testing for safety criteria specified in Article 2.6 – QCVN 101:2016/BTTTT.

Although QCVN 101:2020/BTTTT includes both performance and safety requirements, the Ministry of Information and Communications may issue documents for temporary guidance not to apply the performance testing part (due to long testing time and high costs).

=> Therefore, enterprises may only need to measure safety criteria in section 2.6 and transport criteria in section 2.6.2.7.

3. Transport criteria 2.6.2.7. Transport

The manufacturer’s instruction manual must provide instructions on the transport of Lithium Batteries according to United Nations provisions for the transport of dangerous goods.

=> According to the management requirements of QCVN 101:2016/BTTTT, transport criteria only need to be stated in the instruction manual; testing for this criterion is not yet mandatory.

2.6.2.7. Mechanical measurement (battery)

2.6.2.7.1. Vibration measurement

Battery vibration during transport and use does not cause fire, explosion, rupture, leakage, or venting.

2.6.2.7.2. Shock measurement

Battery shock during transport and use does not cause leakage, venting, rupture, explosion, or fire.

=> According to the management requirements of QCVN 101:2020/BTTTT, when measuring Lithium Batteries for portable equipment, it is mandatory to measure vibration and shock criteria for the battery.

4. Mandatory application date Regulation 101:2016/BTTTT will take effect from July 1, 2018, or Lithium Battery products used for phones, tablets, and laptops must apply the new regulation from July 1, 2018. Regulation 101:2020/BTTTT will take effect from July 1, 2021, meaning Lithium Battery products used for phones, tablets, and laptops must apply the new regulation from July 1, 2021.
